This page blends two handout inserts prepared for and brought to the Case Management Conference held on August 27, 2026, but not distributed as planned due to docket and time constraints at the hearing: Insert 4 (Urbanization Threshold Matrix) and Insert 5 (Urban Sprawl & Density Violation Analysis). All quoted statutory text is verbatim. Project figures are from the County's own PL23-0051 project description.

What SOAR Actually Says About Farmworker Housing

"To the extent possible, farm worker housing, located in existing urban areas, should be encouraged in order to help sustain the viability of agriculture."

SOAR Sec. 1.H — Urban Encroachment (verbatim)

SOAR does not create a blanket exemption for farmworker housing on Agricultural or Open Space land. The text encourages farmworker housing in existing urban areas — not on voter-protected Agricultural/Open Space land outside those areas.

The same section explains why: urban encroachment into Agricultural, Open Space and Rural areas can negatively impact agriculture by lessening cultivated acreage, threatening the viability of the agricultural industry, and could threaten public health, safety and welfare by causing increased traffic congestion, air pollution, and water problems.

The farmworker housing language is a preference for location — existing urban areas — not a pathway to bypass the urbanization threshold on protected land.

SOAR Voter Intent — Verbatim

"It is the intent of the voters that the provisions of this measure shall be interpreted by the County and others in a manner that facilitates the confinement of urban uses thereby protecting and promoting agricultural, open space and rural lands, and preventing urban sprawl for the duration of the Ordinance."

SOAR Sec. 6 — Voter Intent (verbatim)

SOAR Land Use Designation Matrix

Ventura County SOAR Ordinance (Measure B, 1998; Measure C, October 2015, effective through 2050)

The Urbanization Threshold row (highlighted) is the critical trigger for this case.

Open Space (SOAR Exhibit A/B)

Density Standard

10-acre minimum parcel. No residential structures except caretaker units.

Voter Approval Required?

YES — countywide vote required to redesignate.

Farmworker Exception?

No direct farmworker housing exception. Housing exception requires Agricultural designation.

PL23-0051 Relevance

Portions of the project site baseline are mapped as Open Space on SOAR Figure 3.1 South Half (Exhibit A).

Agricultural (SOAR Exhibit A/B)

Density Standard

40-acre minimum parcel. 1 principal dwelling unit per 40 acres.

Voter Approval Required?

YES — countywide vote required to redesignate.

Farmworker Exception?

Yes — SOAR Sec. 2.1(n): farmworker housing on Ag-designated land may qualify for exception if conditions met.

PL23-0051 Relevance

Project site was Agricultural on the 1997 Measure B baseline map. Measure C incorporated maps revised through October 2015 as an updated protected baseline. The farmworker housing exception argument depends on the designation on both voter-adopted map records.

Rural

Density Standard

2-acre minimum parcel. 1 principal dwelling unit per 2 acres. Maximum = 1 du / 2 ac.

Voter Approval Required?

YES — countywide vote required to redesignate.

Farmworker Exception?

No. Farmworker housing exception applies to Agricultural designation only.

PL23-0051 Relevance

Rural is the last protected tier before Urban. Exceeding 1 du/2 ac crosses into Urban intensity (urbanization).

Existing Community (ECU) Per Area Plan

Density Standard

Density per applicable Area Plan or Community designation (ECU-Ag, ECU-OS, ECU-Residential, etc.)

Voter Approval Required?

YES — if redesignating from ECU-Ag or ECU-OS to urban use.

Farmworker Exception?

No direct farmworker exception within ECU-Ag. Must comply with SOAR and Area Plan.

PL23-0051 Relevance

4884 N. Ventura Avenue is designated ECU-Agricultural on the 2040 GP maps (Res. 20-106). Under the writ's contention, urban-density housing on ECU-Agricultural land requires an adopted General Plan amendment and SOAR compliance.

URBANIZATION THRESHOLD

Density Standard

More than 1 principal dwelling unit per 2 acres. Under the writ's reading of SOAR, this constitutes Urban intensity.

Voter Approval Required?

Under the writ's contention: crossing this threshold constitutes urbanization and requires voter approval.

Farmworker Exception?

Farmworker housing exception (Sec. 2.1(n)) must be verified on the record before this threshold is crossed without a vote.

PL23-0051 Relevance

Key question for PL23-0051: Does the proposed project exceed 1 du/2 ac on ECU-Agricultural land? If yes — urbanization is triggered and a SOAR vote is required unless a qualifying exception applies.

Urban

Density Standard

Greater than 1 du / 2 acres. Urban centers: residential, commercial, industrial at urban intensity.

Voter Approval Required?

YES — countywide vote to redesignate from Ag/OS/Rural.

Farmworker Exception?

No. Urban designation is the outcome after a vote — not an exception pathway.

PL23-0051 Relevance

Urban intensity is what SOAR was enacted to prevent on protected land without voter approval.

Authority Chain: County Position vs. The Record

Each row states what the County's approval relies on, what the public record shows, and what has not been identified in materials reviewed to date.

ECU-Agricultural Designation

County Position

The 2040 General Plan designates the site ECU-Agricultural (Res. 20-106), providing the land use framework for the project.

Record Shows

GP2040 Resolution 20-106 exists in the record and does designate the site ECU-Agricultural.

Not Identified in Materials Reviewed

The adopted act or finding that moved this land from the Agricultural/Open Space framework in the SOAR baseline record into the ECU-Agricultural / Existing Community approval pathway. What ordinance, resolution, or General Plan amendment accomplished that transition, and when?

SOAR Baseline Map Status

County Position

The project is consistent with the applicable land use designation.

Record Shows

The 1997 Measure B baseline map shows the site as Agricultural/Open Space. Measure C (October 2015) incorporated maps revised through October 20, 2015 as the updated protected baseline.

Not Identified in Materials Reviewed

The designation of this parcel on the October 2015 Measure C voter-adopted baseline maps. Materials reviewed to date do not identify the specific Measure C map entry for this parcel.

Farmworker Housing Exception

County Position

The project qualifies as farmworker housing under SOAR Sec. 2.1(n) and Health & Safety Code provisions.

Record Shows

SOAR Sec. 2.1(n) provides a farmworker housing exception for Agricultural-designated land. H&S Code Sec. 17021.6 caps the agricultural land use exemption at 12 units or 36 beds.

Not Identified in Materials Reviewed

The adopted findings establishing that this site meets the SOAR Sec. 2.1(n) conditions. The record does not identify findings that the 328-unit project satisfies the statutory cap or that the exception was formally invoked through an adopted act.

Urbanization Threshold Analysis

County Position

The project does not trigger the SOAR urbanization threshold.

Record Shows

SOAR defines the urbanization threshold as more than 1 principal dwelling unit per 2 acres. At 328 units on approximately 19.5 acres, the project density is approximately 16.8 du/acre — approximately 33.6 times the threshold.

Not Identified in Materials Reviewed

An adopted finding or authority that the urbanization threshold does not apply to this project, or that a qualifying exception was satisfied. Materials reviewed to date do not identify such a finding.

Voter Approval / SOAR Vote

County Position

No SOAR vote is required because the project qualifies under applicable exceptions.

Record Shows

SOAR Sec. 6 states voter intent to confine urban uses and prevent urban sprawl. A countywide vote is required to redesignate Agricultural, Open Space, or Rural land to Urban intensity without a qualifying exception.

Not Identified in Materials Reviewed

The adopted authority establishing that a qualifying exception applies and that no voter approval is required for this project at this density on this land. Materials reviewed to date do not identify that authority.

North Ventura Avenue Area Plan Compliance

County Position

The project is consistent with the North Ventura Avenue Area Plan.

Record Shows

The NVAA Area Plan exists in the record. The plan governs land use in the North Ventura Avenue corridor.

Not Identified in Materials Reviewed

The specific NVAA Area Plan provision that authorizes 328 units of urban-density housing on ECU-Agricultural land in this corridor, and any adopted amendment to the Area Plan that accommodates this project.

Technical Analysis

The Density Math & State Law Exemption Analysis

At 328 units on approximately 19.5 acres, the proposed project density is approximately 33.6 times the SOAR urbanization threshold. California Health & Safety Code § 17021.6 caps the agricultural land use exemption at 12 units or 36 beds. PL23-0051 proposes 328 units — 27.3 times the statutory cap. The detailed density math, state law tables, and closing analysis are on the advanced evidence page.
