Density Math, State Law Exemptions & the Urbanization Threshold

A technical cross-reference of SOAR density thresholds, California Health & Safety Code exemption caps, and their application to the 328-unit Ventura Ranch proposal. All figures are from the County's own project description.

This page contains the technical density and state-law analysis prepared for and brought to the Case Management Conference held on August 27, 2026, but not distributed as planned due to docket and time constraints at the hearing — Insert 4 (Urbanization Threshold Matrix) and Insert 5 (Urban Sprawl & Density Violation Analysis). All quoted statutory text is verbatim. Project figures are from the County's own PL23-0051 project description.

The Density Math for PL23-0051

Project figures from the County's own project description

Proposed units328 units
Net developable acreage~19.5 acres (3 parcels)
Calculated density~16.8 dwelling units per acre
SOAR urbanization threshold1 du / 2 acres = 0.5 du/acre
Project density vs. threshold33.6× the SOAR urbanization threshold

At approximately 16.8 du/acre, the proposed project exceeds the SOAR urbanization threshold by a factor of approximately 33.6. This is not a close question on the density math.

What the Applicant Proposes

Ventura Ranch site plan showing approximately 20 multi-story residential buildings, perimeter surface parking lots, internal roads, a central recreation plaza, community center, and two playgrounds on approximately 19.5 acres at 4884 N. Ventura Avenue
Ventura Ranch — Applicant's Site Plan, 4884 N. Ventura Avenue. The plan shows approximately 20 multi-story residential buildings arranged in clusters, perimeter surface parking lots, an internal road network, a central green recreation plaza, a community center with active area, and two children's playgrounds — all on approximately 19.5 acres of SOAR-protected Agricultural/Open Space land. At 16.8 dwelling units per acre, the proposed density is 33.6× the SOAR urbanization threshold of 0.5 du/acre. This is the applicant's own document from the PL23-0051 project record.

State Law: What Counts as a Unit?

Part 1 of Insert 5 — SOAR Threshold + State Law Definition

SOAR Sec. 3.2 — 'Principal Dwelling Unit'

Verbatim Language

"The Urban land use designation... residential uses where the building intensity is greater than one principal dwelling unit per two acres." SOAR does not separately define 'principal dwelling unit.' The term is used in its ordinary meaning: a self-contained residential living unit designed for occupancy by one household or family group.

Effect on PL23-0051

Each of the 328 proposed farmworker units at Ventura Ranch is a self-contained residential dwelling — kitchen, sleeping, living, and sanitary facilities in a single unit — and constitutes a principal dwelling unit for SOAR threshold purposes. The SOAR threshold is not avoided by labeling the units 'farmworker housing.'

Cal. H&S Code § 17021.5 — Residential Employee Housing Exemption

Verbatim Language

"Any employee housing providing accommodations for six or fewer employees shall be deemed a single-family structure with a residential land use designation..."

Effect on PL23-0051

Residential exemption: 6 or fewer employees only. PL23-0051 proposes 328 units. § 17021.5 does not apply. No exemption.

Cal. H&S Code § 17021.6 — Agricultural Employee Housing Exemption (KEY STATUTE)

Verbatim Language

"Any employee housing consisting of no more than 36 beds in a group quarters or 12 units or spaces designed for use by a single family or household... shall be deemed an agricultural land use for the purposes of this section." Above 12 units / 36 beds: employee housing is NOT deemed an agricultural use — it is a residential use subject to full land use, zoning, and SOAR analysis.

Effect on PL23-0051

THE CRITICAL NUMBER: 12 units. PL23-0051 proposes 328 units — 27.3× the § 17021.6 cap. The agricultural land use exemption is NOT available. Each of the 328 units is a residential principal dwelling unit — every unit counts toward the SOAR urbanization threshold.

The Bottom Line on Density and Authority

SOAR allows farmworker housing on Agricultural-designated land if the conditions of Sec. 2.1(n) are met. But that exception applies to Agricultural-designated land — not to land that the NVAA designated for Open Space/Agriculture preservation and that the County is now treating as ECU-Agricultural / Existing Community. The exception also does not override the urbanization threshold. At 328 units on approximately 19.5 acres, the project exceeds the SOAR urbanization threshold by a factor of 33.6. The farmworker housing label does not change that math.
